Ordinance of City Council Amending the Zoning Map

The Colton City Council back on September 20, 2016, directed staff to change the General Plan land use designations and zoning for properties on East K Street from M-2 (Heavy Industrial) to R-1 (Low Density Residential), West K Street from M-1 (Light Industrial) to R-1 (Low Density Residential) to an appropriate commercial zoning district.  On October 18, 2016, the City Council approved a work plan for the general plan amendment and rezoning of these properties.  A total of 23 parcels are affected by this GPA/Zone change.  What followed was the Planning Commission of the City of Colton (“Planning Commission”) held a public hearing, after giving published notice, on September 26, 2017 to consider recommendations to the City Council of a City-initiated Amendment to the Official Zoning Map for the following properties:  134 East K street—Change of Zone from M-2/SDA (Heavy Industrial/Sensitive Development Area Overlay) Zone to C-2 (General Commercial) Zone and 146-162 East K Street---Change of Zone from M-2/SDA (Heavy Industrial/Sensitive Development Area Overlay) Zone to R-1 (Low Density Residential) Zone.  At the conclusion of the hearing, the Commission recommended approval to the City Council of an Ordinance for Map Amendments and adopted Resolution No. R-35-17 recommending to the Council the approval of the proposed Change of Zone project. 

On October 17, 2017, the City Council directed staff to bifurcate the project by removing the East K Street properties in order to address the pending Conditional Use Permit application at 190 E. K Street.  City staff proceeded to remove the East K Street properties as directed by City Council to be heard as a separate item at a future date.  On January 16, 2018, the City Council of Colton held a duly noticed public hearing at which time all persons wishing to testify in connection with the application were heard and the application was comprehensively reviewed.  After receiving all written and oral evidence presented, including the staff report and findings made in the Ordinance, the City Council hereby found and determined that the proposed Ordinance was consistent with goals and policies of the City General Plan and was reasonably related to the public welfare of the citizens of the City and surrounding regions.  The Change of Zone was consistent with the overall objectives of the Colton General Plan.  The changing of the existing zoning designations from these properties and applying zoning designations that will revitalize residential neighborhoods, preserve existing single family homes and eliminate the amount of conflicts between industrial activity and residential neighborhoods.  The change of zones are consistent with the following policies in the Land Use Element of the General Plan.

On February 6, 2018, Colton City Council Ordinance No. O-02-18, the Council approved the following Changes of Zones:  

- 134 East K Street (APN:  0163-081-120. – Change of Zone from M-2/SDA (Heavy Industrial/Sensitive Development Area Overlay)Zone to C-2 (General Commercial) Zone; and

- 146-162 East K Street (APNs:  0163-081-13 & 14 – Change of Zone from M-2/SDA (Heavy Industrial/Sensitive Development Area Overlay) Zone to R-1 (Low Density Residential) Zone 

The Ordinance will become effective thirty (30) days after its adoption in accordance with the provisions of California law.  The City Clerk will certify to the passage of the Ordinance and cause the same or a summary thereof to be published within fifteen (15) days after adoption in a newspaper of general circulation published and circulated in the City of Colton.
